Apple sued for patent infringement of online digital media distribution

Atlanta-based ZapMedia Services Inc. has filed a complaint against Apple for violating its patents. The company alleges that Apple’s iTunes online music store and the iPod music player are using illegal methods for online distribution of digital media.
ZapMedia claimed that Apple’s distribution of digital from the Apple server to various media players is patented by ZapMedia. ZapMedia has applied for patent rights to the technology in 1999. The first patent suit claimed by ZapMedia was approved in 2006 and another one next week.
To settle the case, ZapMedia wants Apple to share its royalties from the sales of iPods and iTunes Music Store. ZapMedia is demanding that Apple pays the company royalties received by Apple for every iPod sale and iTunes usage.
Robert Frohwein, ZapMedia’s legal counsel said that the company has no choice but to file the lawsuit by virtue of the intellectual property rights that it has for the patented content distribution process.
“When someone takes our vision and our intellectual property without a license after several attempts, we have no option but to protect it through every means available to us,” said Frohwein.
