US Court of Appeals gives “Vista Capable” lawsuit the go ahead

wvista_capable_maxsize2.jpgMicrosoft faces more legal fun and games with the US Court of Appeals rejecting Microsoft’s appeal against a previous ruling by Judge Martha Pechman to allow the “Vista capable” lawsuit to proceed as a class action.

As you may recall Microsoft was found to have misled consumers when it labeled some notebooks as “Vista capable”. Those machines were supposed to run Vista on their system without any glitches. But apparently, this is not so, as some of these “Vista capable” labeled notebooks could not use Vista’s advanced features.

It was argued that Microsoft may have unreasonably created demand for notebooks labeled as “Vista capable”. What made matters even worst, was that these notebooks were sold at high prices since they claimed to be “Vista capable”.

Microsoft may have appealed the merit of the previous orders by Judge Pechman, but it would seem that Microsoft itself may have caused the U.S. Court of Appeals to give the lawsuit the go ahead. This is due to some recent announcements coming from Microsoft that undermined Vista, including one from Steve Balmer a couple of days ago, who said that Vista was “a work in progress”.

Should the lawsuit proceed and a ruling made against Microsoft’s, Steve and his gang will have no one to blame but themselves. They should have adhered to the saying that, if you’ve got nothing good to say, it’s better to say nothing at all - especially when you’re talking about your own products.
